
PATRIC J. KELLY, Esq., is a senior shareholder of Adleson, Hess & Kelly, APC. His practice emphasizes secured creditor bankruptcy, real estate, foreclosure, secured transactions, commercial transactions, business law, and civil litigation defense. His primary concentrations are representing principals (institutional and private lenders, title companies, mortgage companies, foreclosure servicing agents) in bankruptcy and foreclosure transactions involving real property, title issues, real property sales, real property related insurance defense, and commercial litigation. Mr. Kelly earned a Juris Doctor, Summa Cum Laude, from the University of Santa Clara School of Law, 1976.
Mr. Kelly has acted as counsel for the parties or as amicus curiae in several cases of significance to those involved with lending, title, foreclosure, and bankruptcy. These cases include the landmark cases of I.E. Associates v, Safeco Title Insurance Company 39 Cal.3d 281 (1985) and BFP v. Resolution Trust Corp. (In re BFP), 114 S.Ct. 1757 (1994). Other cases of significance include Melendrez v. D & I Investments, Inc. (2005) 127 Cal. App. 4th 1238; Abdallah v. United Savings Bank 43 Cal. App. 4th 1101 (1996); Lindsay v. Beneficial Reinsurance Co. (In re Lindsay), 59 F.3d 942 (9th Cir. 1995); Japra v. Apte (In re Apte), 180 B.R. 223 (9th Cir. BAP 1995); and Nguyen v. Calhoun, 105 Cal. App. 4th 428 (2003); In re McFadyen, 145 B.R. 657 (BKRTCY E.D. CAL. 1992); and Cecconi v. Cecconi (In re Cecconi), (BKRTCY N.D. CAL 2004). Mr. Kelly is a frequent contributor to the United Trustee's Association Newsletter, and has contributed to drafting legislation regarding California real property foreclosure law, which has subsequently become law. Mr. Kelly has also prepared materials for and has taught accredited continuing education courses in the fields of foreclosure and bankruptcy .
Since 1984, Mr. Kelly has been a frequent lecturer at the United Trustee’s Association’s annual seminars in both Northern and Southern California on bankruptcy and foreclosure matters and has lectured for the National Business Institute on "Foreclosure and Repossession In California - How To Do It Right" (1992), and "California Foreclosure and Repossession" (1993).
He is a member of the United Trustee’s Association (an association of lenders, title companies, foreclosure companies, individuals and others involved in the lending and foreclosure industry), the American Bankruptcy Institute, the California State Bar, the Santa Clara County Bar Association and is listed in the Directory of Bankruptcy Attorneys.
Mr. Kelly is also a licensed real estate broker in the State of California and is credentialed to teach college classes in real property law/business.
